Recently, some related parties have submitted a request for exemption from the application of anti-dumping measures for long polyester fiber products to the Vietnam Trade Remedies Authority (the investigating authority).
To consider the exemption request for products described above, the Vietnam Trade Remedies Authority has officially announced, requesting domestic manufacturing companies to collect and confirm the following information:
(i) The capability to produce and supply the products proposed for exemption by domestic manufacturing companies. If already produced and supplied, detailed information on the design capacity, contracts, and sales invoices of the proposed exempted products is requested;
(ii) Opinions and viewpoints on the exemption for the mentioned products.
The deadline for parties to submit feedback is before April 19, 2024. After this deadline, if no feedback is received, companies will be presumed to have no objection to the exemption of the polyester staple fiber products, not high tenacity, not only sewing, with HS code: 5402.33.10, consisting of 100% polyester, size: 300D/4/2 ply, used to produce doormats, unpackaged for retail sale.
Within 45 days from the date of receiving complete and valid exemption applications, the Ministry of Industry and Trade will review the decision to exempt the application of trade remedies. In the event of non-exemption from the application of trade remedies, the investigating authority is responsible for informing organizations and individuals of the reasons for non-exemption from the application of trade remedies.
In cases where organizations or individuals exempted from the application of trade remedies fail to comply with the exemption regulations and conditions, the Ministry of Industry and Trade has the right to revoke the decision to exempt the application of trade remedies and inform the customs authority to handle according to regulations.
