With the purpose to determine procedures and principles related to the importation of “Solar energy cells assembled in modules or arranged in solar panel sheets” originating or exported from Croatia, Jordan, Thailand, Malaysia, and Vietnam are in line with Turkey’s law, the Turkish Ministry of Trade has officially issued a notice regarding the deposit requirement for manufacturing and exporting enterprises from Croatia, Jordan, Thailand, Malaysia, and Vietnam in the investigation of anti-dumping and countervailing measures against solar panel imports.
On November 29, 2023, the Turkish Ministry of Trade initiated an investigation into anti-dumping and countervailing measures for solar panel products originating or imported from Croatia, Jordan, Thailand, Malaysia, and Vietnam. The allegations were that these countries imported goods originating from China, made insignificant alterations, and then exported them to Turkey to evade the duties currently applied to China at a rate of 20 – 25 USD/m².
To prevent or limit the inefficiency of applying safeguard measures, the Council for the Assessment of Unfair Competition in Imports of Turkey decided to apply a deposit amount corresponding to the highest anti-dumping duty currently applied to Chinese manufacturers and exporters, at a rate of 25 USD/m².
According to Article 11 of the Decision on Preventing Unfair Competition in Imports, if the investigating authority issues a decision to apply safeguard measures after the investigation, the guarantee deposits will be recorded as revenue. In case the investigation concludes without applying measures, the application of the guarantee deposits will cease, and the collected deposits will be refunded to the enterprises.
The investigated product in this case is solar energy cells assembled in modules or arranged in solar panel sheets, collectively referred to as solar panels classified under HS code 8541.43.00.00.00.
