Following the issuance of Decision No. 1453/QĐ-BCT dated 19 June 2026 by the Ministry of Industry and Trade (MOIT) initiating the sunset review of the anti-dumping measures imposed on certain welding materials originating in Malaysia, Thailand, and China (Case No. ER01.AD15), the Trade Remedies Authority of Vietnam (TRAV) has released the review questionnaire for the relevant foreign producers and exporters.
Case Background
The sunset review has been initiated to determine whether the anti-dumping measures currently imposed on certain welding materials originating in Malaysia, Thailand, and China should be maintained, amended, or terminated.
As part of the review process, the Trade Remedies Authority of Vietnam, acting as the investigating authority, has distributed questionnaires to foreign producers and exporters identified as interested parties in the proceeding.
According to the investigating authority’s notice, completed questionnaire responses must be submitted no later than 9 August 2026 (Hanoi time).
Requirements for Relevant Companies
The Trade Remedies Authority of Vietnam encourages all relevant foreign producers and exporters to actively participate in and fully cooperate throughout the review process in order to safeguard their legitimate rights and interests.
Where a company fails to submit a complete response by the prescribed deadline or provides incomplete or inaccurate information, the investigating authority may rely on the facts available in reaching its determination in accordance with Article 75 of the Law on Foreign Trade Management. Such circumstances may result in adverse outcomes for the company during the review.
Confidentiality and Submission Requirements
According to the Trade Remedies Authority of Vietnam, all information and data submitted by companies in response to the questionnaire will be treated as confidential in accordance with the Law on Foreign Trade Management and the relevant implementing regulations.
The questionnaire provides detailed instructions regarding the completion of each section, submission procedures, and the applicable deadline. Companies are therefore advised to carefully review the instructions and prepare complete supporting documentation before filing their responses.
Assessment and Recommendations
The issuance of the review questionnaire represents an important stage in the sunset review of the anti-dumping measures currently applied to imports of certain welding materials from Malaysia, Thailand, and China. The extent of each company’s cooperation is likely to have a significant impact on the investigating authority’s assessment and the outcome of the review.
Relevant companies should promptly review their export activities during the period concerned and prepare all necessary records, data, and supporting documents to ensure that their questionnaire responses are submitted accurately, completely, and within the prescribed deadline. Full cooperation will not only help protect the companies’ legitimate interests but also contribute to ensuring that the review is conducted on the basis of comprehensive, objective, and reliable information.
To protect their legitimate interests, manufacturers and exporters should familiarize themselves with the procedure and actively contact Vietnam Antidumping Law Firm specializing in anti-dumping and trade remedy for timely assistance.
