On 3 July 2026, the Ministry of Industry and Trade (MOIT) issued Decision No. 1635/QĐ-BCT extending the duration of the sunset review investigation concerning the anti-dumping measures currently imposed on polyester filament yarn originating in India, Indonesia, Malaysia, and China (Case No. ER01.AD10).
Case Background
The sunset review was initiated by the MOIT under Decision No. 3013/QĐ-BCT dated 16 October 2025 to determine whether the anti-dumping measures currently applied to imports of polyester filament yarn from India, Indonesia, Malaysia, and China should be maintained, amended, or terminated.
During the review, the Trade Remedies Authority of Vietnam (TRAV) has been collecting, verifying, and assessing relevant information to determine whether the termination of the existing measures would likely lead to the continuation or recurrence of dumping and injury to the domestic industry.
Extension of the Investigation
Pursuant to Decision No. 1635/QĐ-BCT, the MOIT has decided to extend the sunset review investigation to allow additional time for a comprehensive, objective, and thorough examination of the issues arising during the proceeding.
The extension was made in accordance with Point (d), Clause 2, Article 82 of the Law on Foreign Trade Management No. 05/2017/QH14.
Accordingly, the deadline for completing the investigation has been extended until 14 October 2026.
Assessment
Extensions of investigation periods are a common procedural measure in complex trade remedy proceedings or where additional time is required to collect, verify, and evaluate information submitted by interested parties. Such extensions help ensure that the final determination is based on a complete evidentiary record and is consistent with the applicable legal framework.
During the extended review period, companies and other interested parties should continue to monitor the progress of the investigation and maintain close cooperation with the investigating authority, particularly if requested to provide additional information or participate in verification activities. Proactive cooperation will help safeguard their legitimate rights and interests throughout the sunset review process.
To protect their legitimate interests, manufacturers and exporters should familiarize themselves with the procedure and actively contact Vietnam Antidumping Law Firm specializing in anti-dumping and trade remedy for timely assistance.
