On June 5, 2023, the Ministry of Industry and Trade of Vietnam issued Decision No. 1327/QD-BCT on extending the time limit for issuing the decision to investigate the application of anti-dumping measures on prestressed steel strand products from Malaysia, Thailand and China.
On April 7, 2023, the Trade Remedies Administration, the Ministry of Industry and Trade of Vietnam issued a notice on the receipt and confirmation of the application for an anti-dumping investigation on prestressed steel strand products originating from China, Thailand, and Malaysia from Vietnam’s domestic industry representative.
On April 20, 2023, the Vietnam Trade Remedies Administration continued to notify through Official Letter No. 29/TB-PVTM that the dossier has been fully and duly supplemented in accordance with the provisions of the law on trade remedies. Thereby, the Administration has developed a case file, proceeding to the stage of issuing a notice of initiation of anti-dumping investigation within 45 days from the date of notification of a valid dossier as prescribed in Clause 2 Article 70 Law on Foreign Trade Management.
However, before that, the Administration had informed the investigated enterprises of 3 countries, requesting additional information to be supplemented before May 20, 2023. From the information received from businesses, the Trade Remedies Administration considers that the 45-day period will not be sufficient for the Investigating Agencies to be able to make a reasonable decision based on the available information.
Thereby, in order to have more time to consider, process information and make an investigation decision, on June 5, 2023, the Ministry of Industry and Trade of Vietnam issued Decision No. 1327/QD-BCT on the extension of the time limit for issuing a decision to investigate the case for 30 days (the maximum time limit for extension according to the law). Consequently, the deadline to issue a decision related to this case has been extended to July 5, 2023.
To ensure their legitimate interests, enterprises manufacturing products subject to investigation should contact a reputable law firm specializing in anti-dumping and trade remedy to receive timely legal support.
