The Vietnam Trade Remedies Administration recently announced the receipt of a valid dossier on the request for investigation to apply anti-dumping measures on prestressing steel strand products from China, Thailand, and Malaysia.
On April 7, 2023, the Trade Remedies Administration, Ministry of Industry and Trade of Vietnam issued a notice that this agency is in the process of confirming the information after receiving the company’s application as the representative for the domestic industry on the request for investigation and application of anti-dumping measures on prestressing steel strand products originating from China, Thailand, and Malaysia.
2 weeks later, on April 20, the Trade Remedies Administration continued to notify that the above dossiers had been fully supplemented and were valid in accordance with the law on trade remedies to proceed with the step of building case files, initiate trade remedy investigations.
According to the provisions of Clause 3, Article 49 of Decree No. 10/2018/ND-CP, within 45 days after confirming the complete and valid dossier, the Trade Remedies Administration will submit it to the Minister of Industry and Trade for consideration to initiate an investigation or not initiate an investigation.
In case of necessity, the issuance of an investigation decision may be extended but not exceeding 30 days, ie the maximum time limit will be 75 days from the date of confirmation of the complete and valid dossier.
Verifying and appraising the content of dossiers of request for investigation of acts of trade remedy circumvention
Regarding the appraisal content, the Vietnam Trade Remedies Administration will have to take the following steps as prescribed in Clause 4, Article 49 of Decree No. 10:
a) Identify acts of trade remedy circumvention;
b) Identify the change in trade flows from the country of origin or the country of export of goods after the decision to apply trade remedies takes effect and this change is the cause of the circumvention of the effective trade remedy measures;
c) Identify damage to the domestic industry or a decrease in the effectiveness of the current trade remedy measure.
In order to serve the appraisal work, as well as ensure the legitimate rights and interests of enterprises, domestic enterprises producing/trading in goods similar to those under investigation should actively cooperate with the Trade Remedies Administration and a reputable law firm on anti-dumping and trade remedies in Vietnam and internationally to receive timely support.
The deadline for providing the above information is May 20, 2023.
