The Intellectual Property Office of Vietnam has made an important announcement regarding the publication of trademark application information, according to the latest changes to the Intellectual Property Law implemented on January 1, 2024. This notice aims to increase transparency and fairness in the trademark registration process.
Article 110 of the Intellectual Property Law Amended
According to Clause 1a, Article 110 of the amended Intellectual Property Law, from January 1, 2024, all trademark registration applications that have not been validly accepted will be publicly disclosed immediately after being received. Instead of waiting for the substantive examination process, this information will immediately appear on the Digital Library of Industrial Property (WIPO Publish).
Decision 1057/QD-SHTT
On October 26, 2023, the Intellectual Property Office of Vietnam issued Decision No. 1057/QD-SHTT on publicizing trademark application information on WIPO Publish. This decision applies to trademark registration applications that have not been validly accepted, starting from the time of receipt.
The above decision takes effect from January 1, 2024, and from that time, all trademark applications that have not been validly accepted will be disclosed on WIPO Publish to enhance community control and evaluation of trademark applications.
The decision also details the list of publicly available directory information fields, helping interested parties have a comprehensive view of information related to trademark applications that have not been validly accepted. These information fields are listed in detail in the Appendix attached to Decision 1057/QD-SHTT.
These amendments aim to enhance openness and equity in the process of trademark registration, facilitating swift and efficient information retrieval for the business community.
