On November 28, 2023, the Directorate General of Trade Remedies (DGTR) officially released the questionnaire as part of the sunset review of the imposition of countervailing duties on stainless steel welded pipes from China and Vietnam.
A sunset review investigation on countervailing duties related to the import of ‘Stainless Steel Welded Pipes and Tubes’ originating or exported from China and Vietnam was initiated under the Customs Tariff Act of 1975. The investigation aims to determine the existence, degree, and effect of the alleged subsidies.
Exporters and other interested parties known to the competent authority to be related to the aforementioned investigation are requested to provide relevant information by responding to the exporter’s questionnaire and offering their comments, if any.
However, it is possible that their addresses may be incomplete or their email IDs may not be available, and all exporters under investigation may not be directly notified by the managing authority. Therefore, concerned parties should proactively contact the investigating authority or their country’s trade remedy authority to receive the questionnaire and respond.
Exporters/Manufacturers interested in exporting goods under investigation to India can submit their opinions on security concerns within 7 days and on the scope of the product under consideration, if any, along with proposing Product Control Numbers (PCN), if any, within 15 days from the date of the announcement.
Furthermore, exporters/manufacturers can also provide information in the format and manner specified in the questionnaire to the authority within 30 days.
This duty order was issued by the Indian Ministry of Finance and is valid for 5 years from September 17, 2019.
The goods under review are stainless steel welded pipes falling under HS codes: 7306 40 00, 7306 61 00; 7306 69 00, 7304 11 10, 7304 11 90, 7304 41 00, 7304 51 10, 7304 90 00, 7305 11 29, 7305 90 99, 7306 11 00, 7306 21 00, 7306 29 19, 7306 30 90, 7306 50 00, 7306 90 11, 7306 90 19, 7306 90 90. HS codes are not limited to the product scope under review.
As per Indian regulations, after 5 years of application, based on the proposal of the domestic manufacturing industry representative, DGTR must conduct a sunset review to assess the need to continue applying countervailing measures or review the possibility of recurring subsidy practices or damage to the domestic manufacturing industry if the measures are terminated.
Relevant parties must submit their responses to the investigation questionnaire and related information within 30 days from the date DGTR officially sends the investigation questionnaire.
