On September 26, 2025, the U.S. Department of Commerce (DOC) announced the final determination in the anti-dumping (AD) and countervailing duty (CVD) investigations on molded fiber products imported from Vietnam and China, following nearly one year of investigation.
1. Case Overview
- Product under investigation: Molded fiber products.
- Main HS codes: 4823.70.0020, 4823.70.0040; and other codes including 4823.61.20, 4823.61.40, 4823.69.20, 4823.69.40.
- Vietnam’s export value: In 2023, according to data from the U.S. International Trade Commission (ITC), Vietnam exported approximately USD 23 million of these products to the U.S. market.
- AD investigation period: April 1, 2024 – September 30, 2024.
- CVD investigation period: Calendar year 2023.
2. DOC’s Final Determination
2.1. Anti-Dumping Duties (AD)
After deducting the export subsidy rate (3.2%), the final AD duties imposed on Vietnamese companies are as follows:
- Mandatory respondent: 1.38%
- Two companies with separate rates: 1.38%
- All other companies: 212.27% (based on adverse facts available – AFA)
Comparison with China: AD duties range from 49.01% to 477.90%, significantly higher than the rates applied to Vietnam.
2.2. Countervailing Duties (CVD)
- Mandatory respondent: 5.06%
- Two non-cooperating companies: 200.70% (AFA)
- All other companies: 5.06% (based on the mandatory respondent’s rate)
Comparison with China: CVD duties range from 7.56% to 319.92%, also higher than Vietnam in many cases.
3. Next Steps and Recommendations
Under U.S. law, the International Trade Commission (ITC) will issue its final determination on injury within 45 days of the DOC’s final decision, expected on November 8, 2025. If the ITC concludes that the U.S. domestic industry has suffered material injury from dumped or subsidized imports, an official duty order will likely be issued around November 15, 2025.
The Trade Remedies Authority of Vietnam (TRAV) under the Ministry of Industry and Trade recommends that Vietnamese exporters:
- Continue closely monitoring ITC’s developments and final conclusions;
- Proactively prepare business strategies and diversify export markets;
- Enhance competitiveness and ensure compliance with import market regulations to mitigate risks in the event of duty imposition.
