On October 1, 2025, the Trade Remedies Authority of Vietnam (TRAV) under the Ministry of Industry and Trade issued Notice No. 170/TB-PVTM regarding the receipt of applications for exemption from trade remedy measures for the year 2026. This procedure plays an important role in balancing the objective of protecting domestic industries while enabling enterprises to access input materials not produced domestically, thereby ensuring stable business operations.
Legal Basis
The Notice was issued pursuant to Articles 12, 13, 16, and 17 of Circular No. 26/2025/TT-BCT dated May 15, 2025, of the Minister of Industry and Trade, which sets forth detailed provisions on the procedures, conditions, and documentation for exemption from trade remedy measures in specific cases.
Eligible Applicants and Scope
Enterprises involved in cases listed in the annex of Notice No. 170/TB-PVTM, if meeting the exemption criteria, may submit exemption applications for 2026. Required documents under Article 16 and Annex II of Circular No. 26/2025/TT-BCT include:
- Application form for exemption;
- Supporting documents proving the need for imported goods;
- Evidence that domestic products cannot meet requirements in terms of quality, type, or quantity;
- Other documents as guided in detail by the Trade Remedies Authority of Vietnam.
Supplementary Applications for 2025
Enterprises already granted exemptions for 2025 but nearing the exhaustion of their allocated volume may submit supplementary exemption applications under Clause 4, Article 17 of Circular No. 26/2025/TT-BCT. Such applications may be filed at any time in 2025, without being restricted to the regular review periods.
