On 19 December 2025, the United States Department of Commerce (DOC) published its final determinations in the countervailing duty (CVD) and anti-dumping (AD) investigations concerning imports of hard capsule shells, classified under HS codes 9602.00.1040 and 9602.00.5010, originating from Vietnam. These investigations were initiated in November 2024, and preliminary determinations were issued in March 2025.
Within the scope of the investigations, Vietnam had only one mandatory respondent exporting the investigated products to the United States market. Accordingly, the subsidy margin and dumping margin determined for the mandatory respondent were applied on an industry-wide basis. According to the DOC’s final determinations, the margins applicable to imports from Vietnam were established as follows: a final subsidy margin of 2.45 percent and a final dumping margin of 46.24 percent, after adjustment to offset export subsidy margins.
In parallel with Vietnam, the United States conducted CVD and AD investigations on imports of hard capsule shells from Brazil, China, and India. The investigation results indicated that the dumping margin applied to Vietnamese products was higher than those determined for products originating from China and India, but lower than the margin applied to imports from Brazil. With respect to the countervailing duty investigation, Vietnam recorded the lowest subsidy margin among the countries under investigation.
Regarding the next steps, the United States International Trade Commission (ITC) is continuing its injury investigation and is expected to issue its final determination in the near future to decide whether countervailing and anti-dumping measures will be imposed on imports of hard capsule shells from the countries concerned. In the event that measures are imposed, the issuance of duty orders is expected in February 2026.
The Trade Remedies Authority of Vietnam recommends that relevant enterprises closely monitor developments in the case and proactively formulate appropriate response strategies and plans for the subsequent phase.
