The Philippines does not apply safeguard measures against Linear Low-Density Polyethylene

After a long investigation, the Philippines finally issued a notice not to apply safeguard measures against Linear Low-Density Polyethylene (LLDPE) imported from Vietnam.

Regarding the investigation of Linear Low-Density Polyethylene (LLDPE) products, the Vietnam Trade Remedies Department has worked closely with the Philippine Department of Industry and Trade for a long time and has repeatedly expressed opinions on the case and proposed recommendations for the investigation of the DIT to exclude Vietnam from the scope of application of safeguard measures in accordance with the provisions of the Agreement on Safeguards of the WTO.

The Philippines welcomes all comments submitted and gives careful consideration to all aspects of them in connection to the case.

Do not apply safeguards to Linear Low-Density Polyethylene particles

Recently, on April 21, 2022, the Philippine Customs Commission concluded the investigation of applying safeguard measures against Linear Low-Density Polyethylene (LLDPE). The HS code of the case is 3901.10.12; 3901.10.92; 3901.40.00; 3901.90.90.

After a thorough investigation, the Philippines has come to the conclusion that there is no increase in imports of the goods under investigation into the Philippines in the case of the investigation of the application of safeguard measures against Linear Low-Density Polyethylene either absolute or relative for the survey period from 2015 to June 2021.

Accordingly, the Philippines finally decided not to apply safeguard measures against Linear Low-Density Polyethylene particles. Reportedly, this decision was based on the proposal in the investigation report of the Philippine Tariff Commission (TC).
