On July 28, 2022, Mexico published the official gazette on the initiation of an anti-dumping investigation against cold-rolled steel products imported from Vietnam.
Mexico initiated the investigation after receiving complaints from large domestic cold-rolled steel producers and exporters.
Case basis
According to the lawsuit, the alleged products are cold rolled steel products with HS codes: 7209.16.01, 7209.17.01, 7209.18.01, 7209.26.01, 7209.27.01, 7209.28.01, 7209.90.99, 7211.23 .03, 7211.29.99, 7211.90.99, 7225.50.07, and 7226.92.06.
Based on preliminary data from the International Trade Center (ITC) (http://trademap.org), in 2020, Mexico imports about 220 million USD of iron and steel from Vietnam. This import level increased by about 70% compared to 2019.
In which, nearly 80% of products are products with HS code 7209 under the investigation scope of this case and HS code 7210 under the investigation scope of the previous case when Mexico investigated anti-dumping with galvanized steel.
The total export turnover in 2020 of the groups of cold-rolled steel products under investigation is about nearly 50 million USD.
Initiating an anti-dumping investigation on cold-rolled steel imported from Vietnam
From the date of the official notice of initiation of the anti-dumping investigation (July 28, 2022), Vietnamese cold-rolled steel producers and exporters mentioned in the lawsuit filed by Mexican producers and exporters will have a time limit of 40 days (i.e. September 6, 2022) to submit responses to the survey questionnaire issued by the Mexican Investigation Agency.
Documents submitted by the Mexican Investigation Agency are in Spanish and accordingly, documents submitted by the parties involved in the case to the Mexican Investigation Agency must also be translated into Spanish, notarized, and consular legalized according to regulations.
It is expected that within 130 days from the date of initiation of the investigation, the Mexican Ministry of Economy will make a preliminary conclusion on the case.
Enterprises manufacturing and exporting cold-rolled steel in Vietnam should note that answering the survey questionnaire is mandatory. If responses are not made, the business may be subject to a non-cooperation duty rate that is often especially higher compared to the duty rate imposed on goodwill cooperation.
Accordingly, in order to protect their legitimate interests, enterprises producing and exporting cold-rolled steel products imported from Vietnam need to actively review the export activities of cold-rolled steel products related to Mexico, and study and understand the anti-dumping investigation regulations and procedures of Mexico and fully cooperate with the Investigation Agency of Mexico, as well as the Vietnam Department of Trade Remedies.
