Philippines Initiates Safeguard Investigation into Imports of Pork Products from Various Countries and Territories

On 9 October 2026, the Philippine Department of Agriculture (DA) initiated a preliminary safeguard investigation into imports of certain pork products from various countries and territories. The investigation was notified to the World Trade Organization (WTO) on 21 October 2026. The Investigating Authority will examine whether increased imports have caused or threatened to cause serious injury to the domestic Philippine swine industry.

General Information on the Case

The Investigating Authority is the Philippine Department of Agriculture (DA), acting through its Trade Remedies Office (TRO).

The products under investigation include fresh, chilled or frozen pork; certain edible offal; and pig fat. The relevant HS code headings include 0203, 0206 and 0209. The specific product scope is determined by the AHTN codes set out in the Philippine notification.

The investigation was initiated on 9 October 2026, and the DA published information about the case on 15 October 2026. On 21 October 2026, the Philippines notified the WTO Committee on Safeguards of the initiation of the investigation under document G/SG/N/6/PHL/25. The investigation period covers the period from 2021 through August 2026.

The investigation is being conducted pursuant to Philippine Republic Act No. 8800 of 2000 on Safeguard Measures. The DA considers that there is preliminary evidence indicating that increased imports may be causing or threatening to cause serious injury to the domestic swine industry.

The indicators being examined by the Investigating Authority include declining farm-gate prices and farmers’ incomes, reductions in market share and self-sufficiency levels, increased import penetration and rising commercial inventories. However, the Investigating Authority must still assess the causal relationship between increased imports and the injury suffered by the domestic industry.

The initiation of the investigation represents only the beginning of the review process and does not constitute a final determination or a decision to impose safeguard measures.

Investigation Procedures and Deadlines

According to the DA’s notification, the preliminary investigation is expected to be completed no later than 30 days from the date of publication of the notice.

Interested parties are invited to submit written comments, evidence and views within five working days from the date of publication of the notice. Given the relatively short participation period, businesses should proactively confirm with the TRO the applicable filing deadline, the method for calculating the time limit and whether supplementary submissions may be accepted.

For parties required to respond to investigation questionnaires, complete responses must be prepared and submitted within the deadlines specified by the Investigating Authority. As of the WTO notification, no date has been announced for a public hearing.

Recommendations for Vietnamese Associations and Businesses

To proactively monitor and respond to the investigation, Vietnamese industry associations and businesses exporting relevant products to the Philippines should take note of the following matters:

For industry associations, it is important to promptly inform member businesses about the investigation, identify companies exporting pork, offal and pig fat to the Philippines, and cross-check the relevant HS/AHTN codes to determine whether their products fall within the scope of the investigation. Associations should also consolidate businesses’ difficulties and concerns and coordinate with the Trade Remedies Authority of Vietnam to obtain updates on developments in the case.

For manufacturers and exporters, businesses should urgently contact the TRO to clarify their status as interested parties, applicable deadlines and procedures for submitting comments, evidence or questionnaire responses. They should review production and export data, product codes, and the volume and value of exports to the Philippines during the period from 2021 to August 2026. Supporting documents demonstrating their interests and positions should also be prepared where necessary.

In addition, businesses should closely monitor subsequent announcements, cooperate with the Investigating Authority and comply with all deadlines and confidentiality requirements. Proactive communication with the Trade Remedies Authority of Vietnam will also help businesses stay informed and receive timely support throughout the investigation process.

To protect their legitimate interests, manufacturers and exporters should familiarize themselves with the procedure and actively contact Vietnam Antidumping Law Firm specializing in anti-dumping and trade remedy for timely assistance.
