According to information from the Vietnam Trade Office in Canada, on 24 November 2024, the Canada Border Services Agency (CBSA) announced the initiation of an administrative review concerning the anti-dumping (AD) and countervailing (CVD) duties applied to upholstered domestic seating (UDS) originating in or exported from China and Vietnam, as well as goods imported by Ashley Furniture Industries LLC from the United States.
CBSA stated that the purpose of this review is to update the normal values, export prices, and amounts of subsidy applicable to upholstered domestic seating. The review is conducted to implement the Canadian International Trade Tribunal (CITT)’s findings issued on 2 September 2021 and in accordance with CBSA’s administrative review policy, following a request submitted by an importer.
Information collected during the review will be used by CBSA to determine and adjust the AD and CVD duties applied to future import shipments pursuant to the Special Import Measures Act (SIMA).
CBSA’s expected review timeline:
• 24 November 2025 – Initiation of administrative review
• 15 December 2025 (before 5:00 p.m. Eastern Time) – Deadline for Importers’ Responses
• 7 January 2026 (before 5:00 p.m. Eastern Time) – Deadline for Exporters’ and Government Responses
• 2 April 2026 (before 12:00 noon Eastern Time) – Closing of the administrative record
• 13 April 2026 (before 12:00 noon Eastern Time) – Deadline for Parties’ Case Arguments
• 20 April 2026 (before 12:00 noon Eastern Time) – Deadline for Reply/Submissions to Case Arguments
• 22 May 2026 – Publication of CBSA’s review conclusions
Note: The above deadlines may be adjusted.
CBSA warns that if companies (in the AD review) or governments (in the CVD review) fail to provide complete information or do not cooperate with verification, the agency may apply duties based on available information. Consequently, the AD duty rate for Vietnamese products may reach up to 179.5% of the export price, and the provisional CVD duty is 1,914,726.79 VND per unit.
To safeguard the legitimate rights and interests of Vietnamese producers/exporters of UDS, companies are advised to:
• Study and comply with Canada’s relevant legal requirements;
• Provide full information as required in the questionnaire and cooperate closely with CBSA throughout the review process;
• Proactively contact the Trade Remedies Authority of Vietnam to confirm participation in the CVD review and obtain necessary support. Under Article 104 of Decree No. 86/2025/NĐ-CP dated 11 April 2025, all support for Vietnamese traders involved in foreign trade remedy cases is provided upon written request from the traders or industry associations.
