United States Terminates First Administrative Reviews of Anti-Dumping and Countervailing Duties on Paper Plates Imported from Vietnam

On October 28, 2026, the United States Department of Commerce (DOC) announced the termination of the first administrative reviews of the anti-dumping and countervailing duty measures imposed on paper plates imported from Vietnam. The decision followed the petitioner’s withdrawal of all review requests, with no other party requesting that the proceedings continue. Accordingly, the duty rates established in the original investigations remain in effect.

Key Developments in the Case

The reviewing authority was the United States Department of Commerce (DOC), and the products subject to the reviews were paper plates originating from Vietnam. The reviews covered both anti-dumping and countervailing duty measures as part of the first administrative review cycle.

In early August 2026, the American Paper Plate Coalition, acting as the petitioner, withdrew all requests for administrative reviews of both measures. As it was the only party that had requested the reviews, the DOC had no remaining basis to continue the proceedings and therefore decided to terminate the reviews on October 28, 2026.

Existing Duty Rates Remain in Effect

The termination of the administrative reviews does not mean that the United States has revoked or suspended the trade remedy measures imposed on paper plates imported from Vietnam. Instead, the duty rates established in the original investigations remain in effect, as follows:

Countervailing Duties

  • Cooperating companies assigned individual rates: 5.53%.
  • Non-cooperating companies: 225.9%.
  • All other companies: 5.53%.

Anti-Dumping Duties

  • Cooperating companies assigned individual rates: 30.42%. After deducting the export subsidy countervailing duty component, the remaining anti-dumping duty rate is 24.89%.
  • All other companies: 165.27%.

Accordingly, the termination of the reviews means that exporters must continue to comply with the duty rates currently applicable under the findings of the original investigations. In particular, the rate imposed on non-cooperating companies is significantly higher than that applicable to cooperating companies.

Recommendations for Exporters

Companies manufacturing and exporting paper plates to the United States should continue monitoring announcements from the DOC and further developments concerning the existing duty measures. The termination of these reviews does not change companies’ duty obligations. Exporters should therefore proactively verify the applicable duty rates for each exporter and ensure that their customs declarations and duty payments are accurate and compliant.

In addition, companies should maintain comprehensive records of sales prices, production costs, raw material sources, and export activities so that they are prepared to provide information if the United States authorities conduct subsequent administrative reviews or investigations. Cooperation with domestic authorities and proactive preparation of response strategies will help mitigate potential risks associated with exporting to the United States market.

To protect their legitimate interests, manufacturers and exporters should familiarize themselves with the procedure and actively contact Vietnam Antidumping Law Firm specializing in anti-dumping and trade remedy for timely assistance.
