The U.S. Department of Commerce (DOC) has recently issued its post-preliminary determination in the countervailing duty (CVD) investigation on molded fiber products imported from Vietnam.
According to initial information, the products under investigation fall under HS codes 4823.70.0020 and 4823.70.0040, along with certain related codes. The petitioners in the case are Genera, Tellus Products, LLC, and the United Steelworkers (USW). In 2023, Vietnam’s exports of these products to the United States reached approximately USD 23 million.
In its post-preliminary determination, the DOC imposed a CVD rate of 4.64% on the mandatory respondent, an increase from 1.25% in the preliminary determination. The higher rate resulted from the inclusion of an additional transnational subsidy program in the calculation. Notably, for companies deemed non-cooperative, the DOC applied a significantly higher rate of 201.55%, compared to the preliminary rate, due to the identification of new subsidy programs following supplemental investigation based on the petitioners’ allegations.
In the next stage, the DOC will accept rebuttal comments from interested parties no later than September 8, 2025 (U.S. time). A hearing may also be held upon request, and the final determination is expected to be issued on September 24, 2025, though this deadline may be extended depending on the case’s progress.
The increase in CVD rates in the post-preliminary determination reflects a tightening trend in U.S. trade remedy measures, creating significant challenges for Vietnamese exporters seeking to maintain market share. Businesses are advised to closely monitor the case’s developments, cooperate fully and promptly in providing information, and prepare strategies to minimize legal risks and negative impacts arising from the investigation.
