The Trade Remedies Authority of Vietnam (under the Ministry of Industry and Trade) has recently issued Notice No. 136/TB-PVTM, officially announcing the acceptance of applications for exemptions from the application of trade remedy (TR) measures for 2025.
This regulation is based on Circular No. 26/2025/TT-BCT dated May 15, 2025, particularly Articles 12, 13, and 17, along with the application guidelines set out in Article 16 and Appendix II. Applications are applicable to specific cases listed in the attached annex.
Enterprises that have already received exemptions for 2025 but whose validity is about to expire may submit supplementary applications at any time during the year, in accordance with Clause 4, Article 17 of the Circular. The notice on the acceptance of exemption applications for 2026 is expected to be issued on the first working day of October 2025.
Exemptions from TR measures play an important role for exporters in the context of rising global trade remedy cases. As of mid-2025, Vietnamese exports had faced more than 291 trade remedy cases in various markets, with the United States accounting for a significant share. Investigations into TR circumvention have also been increasing sharply, reflecting the more complex and stringent measures being applied by importing countries.
In this situation, the timely and complete submission of exemption applications not only helps enterprises maintain stable export activities but also reduces the risk of being subject to high trade remedy duties. The Trade Remedies Authority is also operating an early warning system to help businesses anticipate and prepare for the risk of investigations.
