Vietnam’s Ministry of Information and Communications has taken a significant step in safeguarding consumer interests with the enactment of new regulations aimed at enhancing oversight of unsafe Information and Communication Technology (ICT) products. Circular 04/2023/TT-BTTTT, scheduled to come into effect on May 15, 2024, marks a pivotal moment in ensuring that technology products entering the Vietnamese market meet stringent safety and compliance standards.
The primary objective of the regulation is to ensure consumer safety by imposing stricter conformity certification and declaration requirements on potentially unsafe ICT products. Under the provisions of the circular, a comprehensive list of products deemed potentially unsafe has been established. Among these are radio transmitters and receivers, spanning a broad frequency range inclusive of those integral to mobile communications infrastructure such as 5G base stations. Additionally, radar equipment, short-range radio devices, as well as IT equipment like computers and tablets fall within the scope of the new regulations.
Central to the Ministry’s directive is the emphasis on bolstering the quality management of these products through strict oversight and adherence to Vietnamese technical standards. Manufacturers and importers will be subject to more rigorous scrutiny to ensure compliance with relevant technical regulations. This move is pivotal in assuring consumers that the ICT products they purchase meet the highest safety and quality standards.
Moreover, the regulations extend to both standalone ICT products and those integrated into other goods, ensuring a comprehensive approach to consumer protection. In instances where multiple technical regulations are applicable, products must demonstrate conformity across all relevant standards.
In addition to strengthening existing technical regulations, the circular also lays down a framework for adapting the compliance regime to accommodate emerging standards. This forward-looking approach ensures that Vietnam remains at the forefront of technological advancements while maintaining robust consumer protection measures.
To address any ambiguities regarding the classification of imported goods, the Ministry of Information and Communications will collaborate closely with the General Department of Customs to provide clear guidance for unified implementation. This collaborative effort underscores the government’s commitment to streamlining processes and ensuring the effective implementation of the new regulations.
