Recently, A Vietnam Labor Law Conference 2021 just took place in Ho Chi Minh City. The conference has attracted the attention of many renowned individuals such as HR directors, internal lawyers, and lawyers of a law consulting firm specializing in Labor Law. Following the topic of the event “Labor law in the industrial era 4.0”, the speakers at the conference have discussed the impact of Labor Law on the production and business activities of the enterprises.
Businesses in Vietnam have to make great changes to cope with the new normal brought by the Covid-19 pandemic. Therefore, nowadays, the Government needs to make adjustments in the current Labor Law as well as the management for business operation in the 4.0 industrial era.
The ongoing impacts of the Covid-19 pandemic have been creating great pressure on the normal operation of businesses in 2021, in which the human resource issue is considered the most urgent. This year’s Labor Law Conference with the theme “Labor Law in the Industrial era 4.0” aims to accompany businesses in driving development along with the rapid advancement in technology as well as to match and comply with the new provisions of the labor law when the impacts of the Covid-19 pandemic is still prominent.

According to specialists, besides the positive aspects, 4.0 technology also creates a lot of pressure that makes businesses have to actively remodel their business operation, recruitment, and human resource management. Of these, the transition from traditional, physical work at the company to online working methods has been utilized by most businesses. However, when implementing online activity, businesses will need to pay attention to several legal issues related to regulations on working locations, working hours, rest times, handling labor discipline, assessing the working capacity of employees…
Improvement in the new Vietnam Labor Code 2021
As for the differences of the Labor Code in 2021, according to information from the speakers, on November 20, 2019, the National Assembly passed the Labor Code 2019 and it took effect on January 1, 2021. The new Labor Code 2019 has replaced the old Labor Code 2012 which has some hindrance and is comparatively out of date compared with the rapid advancement of this industrial era 4.0.
With this new Labor Code, there are many notable changes such as the scope of regulation, regulations on vocational training time, probationary period, labor contract, overtime work, labor regulations, sexual harassment in the workplace. Accordingly, it is essential for businesses to have a clear understanding of the changes in labor law regulations to quickly adapt to this new industrial era 4.0.
