On December 31, 2025, the Ministry of Industry and Trade of Vietnam issued Decision No. 3804/QĐ-BCT to initiate a new exporter review in the anti-circumvention trade remedy investigation concerning certain sugar products (Case No. NR04.AC02.AD13-AS01). This marks the next step in the trade remedy proceeding to ensure that the application of trade remedy measures is conducted in a transparent manner and in compliance with applicable legal regulations.
1. General Information on the Extension of the Review
Pursuant to Articles 82 and 90 of the Law on Foreign Trade Management No. 05/2017/QH14, and in order to allow additional time for a comprehensive and objective assessment of issues related to the case, on March 27, 2026, the Ministry of Industry and Trade issued Decision No. 570/QĐ-BCT on the extension of the new exporter review period.
According to this decision, the new exporter review in the anti-circumvention trade remedy investigation on sugar products has been extended by an additional three months. The investigation is now scheduled to conclude on June 30, 2026.
The extension is intended to provide the investigating authority with sufficient time to collect and analyze data, evaluate information submitted by interested parties, and reach an accurate conclusion in accordance with Vietnam’s trade remedy regulations.
2. Implications of the Extension for Interested Parties
The extension of the new exporter review period indicates that the investigating authority is conducting a comprehensive assessment of factors related to potential circumvention of trade remedy measures in the sugar sector.
For exporters and importers, the extension means that they should continue closely monitoring developments in the case, prepare complete documentation and data, and maintain active cooperation with the investigating authority to safeguard their legitimate rights and interests throughout the trade remedy proceeding.
The final review conclusion will serve as an important basis for determining the application of anti-circumvention measures, the level of measures imposed, and the scope of enterprises subject to or exempted from the measures in this case.
