The Ministry of Industry and Trade of Vietnam recently issued an official notice on the extension of the deadline for the final review of the application of anti-dumping measures for a number of H-shaped steel products originating from China.
Decision No. 2301/QD-BCT issued on October 13, 2021 on the final review of the application of anti-dumping measures to a number of H-shaped steel products originating from China was issued to conduct the final review of the application of anti-dumping measures to a number of H-shaped steel products originating from China (Case: ER01.AD03).
It is known that these H-shaped steel products are classified under HS codes: 7216.33.11, 7216.33.19, 7216.33.90, 7228.70.10 and 7228.70.90.
Extension of time limit for final review of the application of anti-dumping measures to some H-shaped steel products
Clause 2, Article 82 of the Law on Foreign Trade Management clearly states that the time limit for the final review of the application of anti-dumping measures must not exceed 9 months from the date of issuance of the review decision.
This time limit may be extended 1 more time but must not exceed 3 months.
Accordingly, the deadline for the final review of the application of anti-dumping measures to a number of H-shaped steel products from China will be July 13, 2022 (9 months from October 13, 2021).
However, considering that this 9-month period is still not enough for the investigation agency to fully consider all perspectives related to the case, on July 12, 2022, the Ministry of Industry and Trade of Vietnam issued Decision No. 1377/QD-BCT on the extension of the final review of the application of anti-dumping measures to a number of H-shaped steel products originating from China.
According to the Decision, the deadline for the final review of the case has been extended to September 5, 2022. The above timeframe is less than the maximum extension of 3 months, i.e. October 13, 2022.
