On September 17, 2024, the U.S. Department of Commerce (DOC) announced preliminary results for the 20th administrative review (POR 20) of anti-dumping duties on frozen catfish fillets exported from Vietnam to the U.S. for the period from August 1, 2022, to July 31, 2023.
In this review, a total of eight Vietnamese exporters were examined, of which the DOC selected two companies as mandatory respondents. According to the preliminary findings, both companies received an anti-dumping duty rate of $0.00/kg. The other six companies also qualified for a separate duty rate of $0.00/kg. As the petitioner withdrew the request to review the nationwide duty rate, it remained unchanged at $2.39/kg.
Since the U.S. has not recognized Vietnam as a market economy, the DOC used substitute values from a third country, typically Indonesia, to calculate the dumping margin for Vietnam. In this review, Indonesia was chosen as the surrogate country due to the DOC’s assessment that: 1) Indonesia has a similar level of economic development to Vietnam; 2) Indonesia has major catfish producers comparable to those under review; and 3) Data from Indonesia is reliable, assisting the DOC in evaluating production factors in Vietnam.
This preliminary result is seen as positive for Vietnamese catfish exporters, as all eight companies received a duty rate of $0.00/kg, a decrease from the previous POR 19 duty rates, which ranged from $0.00/kg to $0.18/kg.
The DOC is expected to issue its final conclusion for this review within 120 days from the announcement of the preliminary findings, around January 31, 2024. Additionally, the DOC has announced that parties can submit requests for the next anti-dumping review (POR 21) for the period from August 1, 2023, to July 31, 2024. Several Vietnamese companies and the U.S. petitioner have already submitted requests for review. The DOC anticipates initiating the next administrative review around October 2024.
