Considering that the deadline for submitting responses to the product scope investigation case for wooden cabinets imported from Vietnam is not enough, on June 21, 2022, the United States Department of Commerce (DOC) issued an Official Notice to the extension of the time to submit comments and provide counter-information to the investigation and the review the product range for some wooden cabinets imported from Vietnam for another 1 week. Thereby, the deadline for submission of comments to the DOC will be extended to 5:00 p.m. June 30, 2022 (Eastern Time), equivalent to 4:00 a.m. July 1, 2022, Vietnam time.
On May 24, 2022, the DOC initiated an investigation into whether or not wooden cabinets were imported from Vietnam and Malaysia into the United States using parts imported from China that were within the scope of the trade remedy measures applied by the United States to similar Chinese products.
On June 7, 2022, the United States Department of Commerce (DOC) issued an official notice on the initiation of an investigation into the evasion of anti-dumping and anti-subsidy duties on wooden cabinets imported from Vietnam and Malaysia.
If products such as wooden cabinets and parts covered by the trade remedy measure are further processed in a third country, including but not limited to: planing, cutting, grooving, punching, drilling, painting, coloring, finishing or other operations, etc., such products will remain within the scope of anti-dumping/anti-subsidy duty.
The investigation is applied to both aspects of the application of the US wood cabinet manufacturers, the product scope review, and the duty evasion investigation.
For wood manufacturing and exporting enterprises in Vietnam – the stakeholders in the case will have 30 days from the date of initiation to submit comments and provide counter-information to the US investigation agency, that is, 30 days from May 24, 2022.
According to the law, the DOC will issue a final conclusion within 120 days from the date of initiation. However, this period can be extended for another 180 days if there is a good reason.
Extension of time to submit comments and provide feedback to the investigation
Considering that the time limit of 30 days from the date of initiation to submit comments and provide counter-information to the investigation agency of the United States is not sufficient for Vietnamese manufacturing and exporting enterprises, the United States Department of Commerce has announced the extension of the time to submit comments and provide counter-information to the investigation until 4:00 am on July 1, 2022, Vietnam time, equivalent to 5:00 pm on June 30, 2022 (Eastern Time), that is, 1 week from the previous deadline of June 24, 2022.
To ensure their legitimate interests, enterprises producing/exporting wooden cabinets should contact and cooperate closely with the Trade Remedies Administration and the US Department of Commerce, along with, contacting and collaborating with reputable law firms in Vietnam and internationally on anti-dumping to acquire solutions to help overcome this difficult situation.
