Recently, the US Department of Commerce (DOC) announced the 7th extension of the deadline for issuing the final conclusion in the case of anti-circumvention investigation of certain hardwood plywood products from Vietnam, suspected of evading anti-dumping and anti-subsidy duties imposed by the United States against China.
On June 17, 2020, the US Department of Commerce announced the initiation of an investigation into the circumvention of trade remedies against Vietnam in light of the order to impose anti-dumping and anti-subsidy duties on some plywood products use solid hardwood materials from China.
In July 2022, the Ministry of Trade announced the preliminary decision in the investigation of circumvention of trade remedies against Vietnam, stating that if plywood products imported from Vietnam into the United States have cores using materials imported from China will be subject to anti-dumping and anti-subsidy duties as applied to plywood from China.
However, plywood from Vietnam with cores using materials manufactured in Vietnam or in other countries will not be subject to anti-dumping and anti-subsidy duties.
Pursuant to 19 CFR 351.302(b), the Department of Commerce extended the deadline for making a final conclusion on the anti-circumvention investigation of hardwood plywood products from Vietnam until May 2, 2023.
In addition, the Ministry of Trade also extended the deadline for submitting documents certifying imported and exported plywood products from June 17, 2020 to August 28, 2022 until thirty days after the final decision on these requirements.
The Department of Commerce has received a significant number of briefs on their case and requests for dismissal and exemptions, and as a result, more time is needed to analyze, review and respond to the issues outlined in such summaries prior to making a final decision.
For the above reasons, pursuant to 19 CFR 351.302(b), the DOC extended the deadline for making a final decision on the anti-circumvention investigation of hardwood plywood products from Vietnam until May 26, 2023.
It is known that this is the 7th time that the US Department of Commerce has extended the deadline for issuing the final conclusion in the case of anti-circumvention investigation of hardwood plywood products from Vietnam. The 6th extension took place in March 2023, extended until May 2, 2023.
