Requesting an investigation of the application of anti-dumping measures on long-fiber products made from polyester (PFY) originating from China, India, Indonesia and Malaysia

The Ministry of Industry and Trade shall receive a complete and valid application file for requesting an investigation of the application of anti-dumping measures on long-fiber products made from polyester (PFY) originating from China, India, Indonesia and Malaysia.

30/01/2020 – On November 7, 2019, the Vietnam Chamber of Commerce (Investigation Agency) received the investigation request dossier for application of anti-dumping measures on long-fiber products made from polyester. (PFY) originating from China, India, Indonesia and Malaysia from companies representing the domestic manufacturing industry (requesting party).

On November 22, 2019, the investigating agency issued official dispatch No. 1056 / PVTM-P1 requesting the requesting parties to supplement and adjust to clarify some contents about the investigated goods, methods and facilities of dumping margins and losses of the domestic industry. On December 31, 2019, the requesting Party submitted all additional information as required. On 9 January 2020, the requesting Party shall provide additional documents to clarify additional information on the method of calculation and determination of the requesting Party’s dumping margin. On January 21, 2019, the investigating authority confirmed that the dossier is complete and valid in accordance with the law on trade remedies.
Within 45 days from the date of receiving a complete and valid file, the Investigation Agency will appraise the dossier to submit to the Minister of Industry and Trade for consideration whether to conduct an investigation or not to conduct an investigation of the case.
Contents of dossier evaluation include:
(i) Determine the legal status of the domestic industry of organizations and individuals that submit applications in accordance with the Law on Foreign Trade Management;
(ii) Determine evidence on the dumping of imported goods that cause or threaten to cause significant injury to a domestic manufacturing industry or substantially prevent the formation of a domestic manufacturing industry.
In order to serve the evaluation, as well as to ensure the legitimate rights and interests of the enterprise, the Investigation Agency recommends that the domestic enterprises producing / trading in the same goods mentioned above provide the following information:
– Information about the business;
– Design capacity and production of long fiber products made from polyester (PFY) in 2016, 2017, 2018 and 2019;
– The company’s opinion on the case (agree, disagree, no opinion);
– Any other documents / evidence that the company thinks is related to the case;
The deadline for the above information provision is before 17:00 on February 14, 2020.
