Since July 2022, the unemployment benefits that employees are entitled to when they are out of job for a set period of time will get increase as this benefit for employees working in private enterprises depended heavily on regional minimum wages. So, what are the new unemployment benefits from July 2022?
According to Decree No. 38 of the Government, the minimum wages in Vietnam will get increased from July 1st, 2022.
Therefore, the unemployment benefits will also be increased from July 1st.
However, it should be noted that the increase is only for employees that have extremely high social insurance contributions.
This is because the regional minimum wages only affect the maximum unemployment benefits that employees can receive.
The unemployment benefits will be calculated according to the following:
- Monthly unemployment benefit = 60% x Average monthly salary on which unemployment insurance premiums are based for the 6 consecutive months before unemployment
- The maximum monthly unemployment benefits = 5 x Regional minimum wages
Because the regional minimum wage in 2022 is adjusted to increase to 6% from July 1, therefore, the unemployment benefits will be increased to a maximum of 4.68 x 5 = 23.4 million VND/month (for employees who pay unemployment insurance according to the salary regime decided by the employer).
The above number doesn’t apply to employees working for the State (cadres, civil servants, and public employees)
For employees subject to the salary regime prescribed by the State, the maximum unemployment benefits shall not exceed 5 times the base salary. Because the present applied base salary is 1.49 million VND/month, the maximum monthly unemployment allowance is 7.45 million VND/month.
Maximum unemployment benefits for employees working in enterprises
As mentioned above, for employees who pay unemployment insurance contributions according to the salary regime decided by the employer, the level of enjoyment shall not exceed 5 times the regional minimum salary as prescribed by the Labor Code at the time of termination of the labor contract which is 23.4 million VND a month.
The unemployment benefit period is calculated according to the number of months of unemployment insurance contribution payment. For every full 12 months of payment of social insurance contributions, the employees will receive 01 month of unemployment benefits but not more than 12 months.
The maximum number of months of unemployment benefits enjoyment is 12. Therefore, the maximum amount of benefits that employees are entitled to are:
- Region I is 280.8 million VND – 23.4 million VND/month;
- Region II is 249.6 million VND – 20.8 million VND/month;
- Region III is 218.4 million VND – 18.2 million VND/month;
- Region IV is 195 million VND – 16.25 million VND/month.
