On January 26, 2022, the Trade Remedies Department received information that the Korea Trade Commission (KTC) had officially extended the time limit for the preliminary investigation of the anti-dumping case against cast copper pipe products with HS code 7411.10.0000 originating from Vietnam and China.
KTC initiated an investigation into the case on October 29, 2021, on the basis of a request received on October 8, 2021.
According to the initial plan, KTC is expected to conduct a preliminary investigation within 03 months and issue a preliminary conclusion on January 28, 2022. However, considering this time is not enough to be able to give the official conclusion, recently, KTC has announced to extend the time of preliminary investigation of the case to March 28, 2022 (two more months than planned).
In order to ensure their legitimate interests, the Trade Remedies Department recommends that manufacturing and exporting enterprises continue to closely monitor information and developments related to the case and actively coordinate with the investigation agency as well as the Trade Remedies Department throughout the course of the case, giving accurate and timely responses when requested.
Extension of time for anti-dumping investigation for cast copper pipe products originating from Vietnam and China
The case of investigating anti-dumping measures for cast copper pipe products originating from Vietnam and China is not the first trade remedy case applied to Vietnamese products in recent times.
Information from the Department of Trade Remedies, Ministry of Industry and Trade, said that by the end of 2020, there have been 201 cases of trade remedies initiated by foreign countries to investigate Vietnam’s export goods. These investigations have had many negative impacts on Vietnamese enterprises, in particular affecting about 12 billion USD in turnover and tens of thousands of export enterprises. As of the second quarter of 2021, there have been 207 cases of trade remedies initiated by 21 countries/territories to investigate Vietnamese exports.

In 2020, Australia emerged as the second most sued against trade remedies (after the US) with Vietnam’s exports with 7 cases, including 4 anti-dumping cases and 3 anti-subsidy cases. In all of these cases, Australia investigated multiple subsidy schemes and alleged special market conditions – another variation of the non-market economy allegation.
Regarding cast copper pipes originating from Vietnam, copper pipes exported to the United States and South Korea have been warned as one of the items on the list of products that are at risk of being subject to anti-circumvention measures, origin fraud, illegal transshipment, or trade remedies announced previously by the Trade Remedies Department.
Therefore, the fact that Korea officially sent an anti-dumping investigation notice for cast copper pipe products originating from Vietnam and China, and continued to send a notice to extend the investigation time did not create that many surprises for the Vietnamese market.
