On August 5, 2024, the Indonesian Safeguard Committee announced the organization of a public hearing for the investigation into the extension of safeguard measures on EPS resin products against Vietnam. On July 22, 2024, the Indonesian Safeguard Committee (KPPI) issued a notice initiating an investigation into the extension of safeguard measures on EPS resin products in granular form, with HS code 3903.11.10.
The Investigating Authority initiated an investigation to extend the safeguard measures after reviewing the documents submitted by the Plaintiff, who was determined to be eligible to file the application due to representing a sufficient majority of EPS resin product manufacturers in the Indonesian market.
According to Article 3.1 of the WTO Agreement on Safeguards, the Investigating Authority will hold a public hearing to provide an opportunity for interested parties to present their evidence and views. Interested parties, such as manufacturers, exporters, representative agencies, governments, etc., involved in the production and export of EPS resin products to the Indonesian market, are encouraged to register for participation.
Details of the hearing are as follows:
- Date: Tuesday, August 13, 2024
- Time: 10:00 AM – 12:00 PM
- Venue: Meeting Room 3, 1st Floor, Main Building, Ministry of Trade, JI. M.I Ridwan Rais No. 5 – Central Jakarta
Interested parties wishing to attend the hearing should fill out the form at the following link: https://kemend.ag/RegistrasiPublicHearingExtEPS (QR code can be scanned from the attached file). Each entity may send up to two representatives to attend. Registration must be completed no later than August 8, 2024. The hearing will be conducted in Indonesian.
To protect their interests, manufacturers and exporters of the investigated product are advised to contact a reputable law firm specializing in anti-dumping and trade remedy for timely support.
It should be noted that any action demonstrating non-cooperation or insufficient cooperation may result in the Indonesian Investigating Authority using adverse available evidence or extending the safeguard measures as proposed by the Plaintiff. The continuation of safeguard measures may reduce competitive advantages and potentially lead to the loss of part or all of the export market to the domestic industry in Indonesia and/or competitors from other countries.
