Regarding the investigation into the application of anti-circumvention measures, anti-dumping and anti-subsidy trade remedies for cane sugar products originating from Thailand, which were accused of evading through the 5 ASEAN countries, recently, in order to ensure that stakeholders have enough time to prepare documents and other procedures, the Ministry of Industry and Trade has issued Decision No.943/QD-BCT to continue extending the time limit for the investigation of the application of anti-circumvention measures against trade remedies for cane sugar products from Thailand for an additional 2 months.
On February 9, 2021, the Vietnam Ministry of Industry and Trade issued Decision 477/QD-BCT applying a temporary anti-dumping and anti-subsidy duty on cane sugar products originating from Thailand.
On June 15, 2021, the Ministry of Industry and Trade continued to issue Decision No. 1578/QD-BCT applying official anti-dumping and anti-subsidy measures to a number of cane sugar products imported into Vietnam originating from Thailand.
On September 21, 2021, the Ministry of Industry and Trade issued Decision No. 2171/QD-BCT investigating the application of anti-circumvention measures of trade remedies to a number of cane sugar products originating from Thailand, accused of evading through 5 ASEAN countries: Laos, Cambodia, Indonesia, Malaysia, and Myanmar.
To be of use to the investigation process, on October 25, 2021, the Investigation Agency sent an investigation questionnaire to stakeholders, including foreign manufacturing/exporting businesses and domestic manufacturing and importing businesses to collect information to analyze, evaluate and clarify allegations as well as investigate acts of evading anti-dumping and anti-subsidy measures.
During the process of receiving the survey questionnaire, the Investigating Agency received requests to extend the time for answering the questionnaires from a number of stakeholders. After considering the requests, the Investigation Agency announced to extend the time to answer the questionnaires to 3 pm on December 16, 2021 (Hanoi time). Next, in order to assist the parties involved in the investigation, the Trade Remedies Department held a public consultation session in investigating the application of trade remedies to a number of cane sugar products which takes place from 14 pm to 17 pm on March 9, 2022 (Hanoi time).

Continuing to extend the investigation period for cane sugar products
In order to ensure that the investigation of the case of applying anti-circumvention measures to trade remedies for cane sugar products is conducted in a comprehensive, objective manner, taking into consideration all the information that the stakeholders have submitted, the Ministry of Industry and Trade has issued Decision No. 348/QD-BCT to extend the time limit for investigating the application of anti-circumvention measures of trade remedies for some cane sugar products for another 2 months. The end of the investigation of the incident is May 21th, 2022.
However, considering the above extension is still not enough to be able to investigate the details of the case in a clear and transparent manner, thereby, based on the opinions of the stakeholders and based on Article 82 of Decree No. 10/2018/ND-CP detailing a number of articles of the Law on Foreign Trade Management on trade remedies, on May 16th, 2022, the Ministry of Industry and Trade issued Decision No. 943/QD-BCT to extend the time limit for investigating the application of anti-circumvention measures to some cane sugar products for another 2 months with the deadline for the investigation of the case is July 21, 2022.
