The Canada Border Services Agency (CBSA) is currently conducting a normal value review as part of the anti-dumping and countervailing duty investigations for upholstered domestic seating originating from Vietnam and China. Presently, CBSA is conducting two normal value reviews at the request of two different Vietnamese importer groups in Canada, which include:
- A normal value review concerning a Vietnamese manufacturer and exporter of upholstered domestic seating products engaged in transactions with Wayfair LLC, based in the United States, and subsequently exported to Canada (file code: UDS 2024 UP2); and
- A normal value review concerning upholstered domestic seating products manufactured by Duc Thanh Company, located at Plot No. 1250, Map Sheet No. 31, Tan Binh Quarter, Tan Hiep Ward, Tan Uyen City, Binh Duong Province (file code: UDS 2024 UP3).
The information regarding these reviews has been publicly announced on the electronic platforms of the Vietnam Trade Remedies Authority and CBSA. According to information from the Vietnam Trade Remedies Authority, the Authority is currently coordinating with relevant ministries and agencies to formulate responses to questions for the government to provide information on Vietnam’s policies, regulations, and laws as requested by CBSA. It is anticipated that the process of formulating responses will be completed and submitted to CBSA before 5 p.m. (ET) on April 29, 2024.

In cases where the related parties do not have transactions with Wayfair LLC but are identified as having a relationship, companies should proactively notify CBSA in writing and/or request CBSA to confirm the non-participation to avoid incorrect taxation.
