On November 15, 2023, the Canada Border Services Agency (CBSA) issued an official notice regarding the initiation of a sunset review of anti-dumping and countervailing duties on cold-rolled steel products originating from China, South Korea, and Vietnam.
On November 14, 2023, the Canadian International Trade Tribunal (CITT), pursuant to section 76.03(1) of the Special Import Measures Act (SIMA), commenced a sunset review investigation based on a decision rendered on December 21, 2018, in Inquiry No. NQ-2018-002, concerning anti-dumping and countervailing measures on certain types of cold-rolled steel originating or exported from China, South Korea, and Vietnam.
As a result of the CITT’s sunset review investigation, the Canada Border Services Agency has initiated a sunset review inquiry to determine, under section 76.03(7)(a) of SIMA, whether the findings from the decision are likely to continue or resume the practice of dumping and/or subsidizing the goods in question. CBSA will make a determination no later than April 12, 2024, and will issue an explanatory statement on April 29, 2024.
As part of the sunset review investigation, CBSA has sent questionnaires to manufacturers, importers, exporters/manufacturers in Canada, and to the governments of China, South Korea, and Vietnam. Any manufacturer, importer, or exporter/manufacturer of the investigated product to Canada who has not received a letter from CBSA and wishes to provide answers to the questionnaire is encouraged to contact SIMA/CBSA.
The deadline for submitting responses to the questionnaire is December 21, 2023.
