On September 3, 2026, the Ministry of Industry and Trade (MOIT) issued Decision No. 2144/QD-BCT on the results of the sunset review of the application of anti-dumping measures on certain sorbitol products originating from India, Indonesia and China, case code ER01.AD14. Accordingly, the MOIT decided not to extend the anti-dumping measures applicable to the goods covered by the case.
Anti-Dumping Measures on Sorbitol
The ER01.AD14 case originated from an anti-dumping investigation initiated by the Ministry of Industry and Trade concerning certain sorbitol products imported from India, Indonesia and China. The products subject to the investigation mainly consist of sorbitol syrup, classified under HS codes 2905.44.00 and 3824.60.00.
Following the investigation, the Ministry of Industry and Trade imposed anti-dumping measures on the products covered by the case. The measures were intended to address the impact of dumped imports on the domestic industry in accordance with Vietnam’s trade remedy regulations.
Under the sunset review mechanism, an anti-dumping measure does not automatically continue after the expiry of its prescribed period. The investigating authority must assess the conditions prescribed by law to determine whether the termination of the measure is likely to lead to the continuation or recurrence of dumping and injury to the domestic industry.
Results of the Sunset Review
In November 2025, the Ministry of Industry and Trade commenced a sunset review of the anti-dumping measures in the ER01.AD14 case. The review was conducted pursuant to the Law on Foreign Trade Management, Decree No. 86/2025/ND-CP and relevant regulations, while also taking into account Vietnam’s commitments under the WTO Anti-Dumping Agreement.
During the review, the investigating authority examined the sunset review application and the information submitted by the interested parties. The results showed that the sunset review application submitted by the requesting party was incomplete and invalid.
Based on these findings, the Minister of Industry and Trade relied on Point b, Clause 7, Article 62 of Decree No. 86/2025/ND-CP to decide not to extend the anti-dumping measures applicable to the investigated goods.
Decision No. 2144/QD-BCT dated September 3, 2026, officially records the results of the sunset review and serves as the basis for ending the extension of the anti-dumping measures applicable to the products covered by the case.
Implications for Businesses
The decision not to extend the anti-dumping measures may create more favorable conditions for businesses importing sorbitol from India, Indonesia and China, while potentially affecting the input costs of businesses using sorbitol in their manufacturing activities.
For importers, attention should be paid to the effective date of termination of the measures, and the applicable tax obligations for each shipment should be determined based on the import date and relevant regulations.
From a trade remedy perspective, the case also highlights the importance of preparing complete and valid documentation when requesting a sunset review. Failure to satisfy legal requirements for the review application may directly affect the possibility of maintaining an existing measure.
