Projects involving land use, environmental clearance, or conditional business lines face additional challenges, as they must meet sector-specific criteria that are not always published transparently.
Inconsistent Application and Enforcement of Laws
Another major challenge lies in the inconsistent application and enforcement of legal provisions across different provinces and cities. While localities all follow national laws, their interpretation and implementation often differ, especially in areas such as land management, construction, and investment licensing—where authority largely rests with local governments.
For foreign investors, this inconsistency adds compliance burdens and undermines predictability and legal certainty. Many enterprises report having to tailor their rollout strategy to each locality, or even resorting to informal lobbying channels to resolve seemingly routine procedures.
Limited Policy Stability and Transparency
A core factor in attracting and retaining FDI is a stable and transparent legal environment. However, in Vietnam, legal provisions may change rapidly without sufficient transition periods, making it difficult for businesses to adapt. Moreover, some newly issued regulations lack proper impact assessment, potentially disrupting ongoing investment activities.
Transparency also remains limited in terms of access to legal information. Many rules are circulated internally only or lack official translations for foreign investors.
