Amidst the dynamic growth of the creative economy and digital transformation, copyright registration in Vietnam has become increasingly important for individuals and organizations operating in culture, arts, technology, and media sectors.
Although copyright is legally established once a work is created in a tangible form, official registration with a state authority remains a crucial step to strengthen legal protection in the event of disputes or infringements.
This article provides updated information on the procedures, timeline, and costs of copyright registration in Vietnam as of 2025.
1. Copyright registration procedure: Required documents and submission methods
Copyright registration is conducted at the Copyright Office of Vietnam under the Ministry of Culture, Sports, and Tourism. The applicant can be the author, the copyright owner, or a duly authorized representative.
A standard application includes:
(i) a copyright or related rights registration form;
(ii) a copy of the work;
(iii) documents proving the right to file; and
(iv) identity papers or business registration of the applicant.
The work may be submitted as a printed copy, audio recording, software, image, or digital format depending on the type of creation.
Applicants may submit documents in person, by post, or online via the Public Service Portal. If a representative is used, a power of attorney must be included.
2. Processing time: Efficient but requires close monitoring
The law prescribes a specific timeframe for processing applications from the date a complete and valid file is received. In practice, processing time may vary depending on the submission method (in person or online), the completeness of the dossier, and the volume of applications being handled by the Office at any given time.
It is essential to monitor the application progress and promptly respond to any requests for amendments or additional documents to avoid delays or disruptions in the commercialization timeline of the work.
3. Copyright registration costs: Depend on type of work and method of filing
The cost of copyright registration in Vietnam are not fixed. They vary based on several factors, including the type of work (literary, software, music, visual art, broadcast programs, etc.), the submission method (in person or online), and whether legal representation is used.
In addition to the official government filing fee, applicants may incur other costs such as administrative fees, notarization or certified copy expenses, and legal advisory fees during the preparation process.
