The Trade Remedies Authority of Vietnam has officially announced that it is accepting requests for an expiry review of the antidumping measures applicable to certain table and chair products originating from China. The case is designated as AD16.
The deadline for review applicants to submit their requests is 3 September 2026. The review results will provide the basis for the Ministry of Industry and Trade to decide whether to continue or terminate the existing antidumping measures.
Antidumping Measures on Tables and Chairs from China
On 13 February 2023, the Ministry of Industry and Trade issued Decision No. 235/QĐ-BCT imposing definitive antidumping measures on certain table and chair products originating from China.
Under this decision, the antidumping measures will expire on 13 February 2028 unless they are extended following an expiry review in which the Ministry of Industry and Trade determines that terminating the measures would likely result in the continuation or recurrence of dumping and injury to the domestic industry.
Legal Basis for the Expiry Review
Clause 1, Article 52 of Decree No. 86/2025/NĐ-CP dated 11 April 2025 provides that, no later than 15 months before an antidumping or countervailing measure expires, the investigating authority must announce that it is accepting requests for an expiry review.
The review will be conducted in accordance with Clause 2, Article 82 of the Law on Foreign Trade Management and Clauses 3 and 4, Article 52 of Decree No. 86/2025/NĐ-CP.
During the review, the investigating authority will examine the likelihood that dumping and injury to the domestic industry would continue or recur if the antidumping measures were terminated.
Deadline for Submitting Review Requests
Pursuant to Clause 2, Article 52 of Decree No. 86/2025/NĐ-CP, a review applicant may submit a request for an expiry review within 30 days from the date on which the investigating authority issues its notice of acceptance of review requests.
For Case AD16, the deadline for the Trade Remedies Authority of Vietnam to receive review requests is 3 September 2026.
Requests must be submitted directly to the Trade Remedies Authority of Vietnam within the prescribed period. Review applicants must ensure that their submissions are complete and valid and contain documents and evidence demonstrating the necessity of continuing the antidumping measures.
Consequences if No Valid Request Is Submitted
Pursuant to Points a and b, Clause 7, Article 62 of Decree No. 86/2025/NĐ-CP, the Minister of Industry and Trade will decide not to extend the antidumping measures in either of the following circumstances:
- The domestic industry fails to submit a request for an expiry review within the prescribed period; or
- A review request is submitted but is not complete and valid within the prescribed period.
Accordingly, if no valid request for an expiry review is submitted, the antidumping measures on certain table and chair products originating from China will not be extended beyond 13 February 2028.
Recommendations for the Domestic Industry
Domestic manufacturers of tables and chairs whose rights and interests are affected should proactively assess the effects of imports from China and consider whether it is necessary to request the continuation of the antidumping measures.
If they intend to request an expiry review, enterprises should promptly collect and prepare information and documents relating to:
- Domestic production, business operations, and sales of the products;
- Production volume, revenue, market share, profits, production capacity, and capacity utilisation;
- Import trends and the selling prices of goods from China;
- The likelihood that dumping would continue or recur if the measures were terminated;
- The likelihood that injury to the domestic industry would continue or recur; and
- The causal relationship between the dumped imports and the injury suffered by the domestic industry.
As the period for accepting review requests ends on 3 September 2026, review applicants should prepare and submit their requests promptly to allow sufficient time to address any issues concerning the completeness and validity of their documents.
