The USA Department of Commerce (DOC) has recently received a petition requesting an anti-dumping duty (ADD) investigation on semi-trailers and related assembly components imported from Vietnam, Mexico, and Thailand. Additionally, the USA is also considering a countervailing duty (CVD) investigation on imports from Mexico and Thailand.
1. Case Information
- Investigated Products: Semi-trailers and assembly components (HS codes 8716.39.0090, 8716.90.5060, possibly including 8716.90.5010).
- Petitioner: USA Trailer Manufacturers Coalition.
- Case Number: A-552-849.
- Date of Petition Filing: February 26, 2025.
- Export Value in 2024: Vietnam – nearly $19 million, Mexico – over $950 million, Thailand – nearly $27 million.
- Accused Enterprises: Four Vietnamese companies were named. If the investigation is initiated, DOC will issue a Quantity and Value Questionnaire (response required within 14 days) to select mandatory respondents (typically the two largest exporters).
- Alleged Dumping Margin: Vietnam – 304.68% (highest among the three countries).
- ADD Investigation Period: July 1 – December 31, 2024.
- Injury Investigation Period: January 1, 2022 – December 31, 2024.
- Surrogate Country: As the USA considers Vietnam a non-market economy, DOC will use surrogate values from a third country to calculate the dumping margin. Parties have 60 days to comment on the surrogate country selection before the preliminary determination.
2. Investigation Process
The investigation involves two agencies: DOC, which investigates dumping practices, and the USA International Trade Commission (ITC), which assesses the injury to domestic manufacturers. Anti-dumping duties will only be imposed if both agencies determine that violations have occurred.
- Step 1: DOC reviews the petition (20 days, decision expected by March 18, 2025).
- Step 2: ITC issues a preliminary injury determination (within 45 days). If no injury is found, the case will be dismissed.
- Step 3: DOC issues a preliminary anti-dumping determination (within 140 days). If there is a surge in imports, DOC may apply retroactive duties up to 90 days before the preliminary determination.
- Step 4: DOC issues a final anti-dumping determination (within 75 days).
- Step 5: ITC issues a final injury determination (within 45 days).
- Step 6: If both dumping and injury are confirmed, DOC will issue an ADD order (within 7 days).
