According to Decree 147/2024/ND-CP on the Management, Provision, and Use of Internet and Online Information recently issued by the Vietnamese Governement replacing Decree 72/2013 and Decree 27/2018, only accounts verified by phone number or personal identification number are permitted to post, comment, or livestream, effective from December 25.
Accordingly, service providers are required to verify social media user accounts via a Vietnamese phone number. If phone verification is not possible, social media platforms will require verification using a personal identification number (CCCD), following regulations on electronic identification and authentication.
Previously, Decree 27/2018/ND-CP allowed social media users to verify their accounts with either an email address or a phone number when registering or updating their information.
One of the other key changes includes managing cross-border information services with platforms that receive over 100,000 monthly visits or use data storage services in Vietnam and users have the right to permit or deny the use of their information for advertising purposes.
Additionally, these providers must store information for users in Vietnam during account registration, including full name, date of birth, a Vietnamese phone number, or personal identification number. For active users, verification must be completed within 90 days from the effective date of the decree.
For users under 16 years old, parents or guardians must register with their information and are responsible for supervising and managing children’s access and posts on social media platforms.
For content that violates the law, service providers must block or remove infringing content within 24 hours of a request from the competent authority.
For accounts, pages, community groups, or content channels with frequent violations (five violations in 30 days or ten in 90 days, as determined by requests from the Ministry of Information and Communications or the Ministry of Public Security), social media platforms must temporarily suspend these pages for 7 to 30 days, blocking access from Vietnamese users.
If an account, page, group, or channel is suspended three times or posts content harmful to national security, social media platforms will permanently block their access from Vietnam.
