The Trade Remedies Administration recently released an update on the warning list of 11 products exported to the US with a continuously increasing market share that are at risk of being subject to anti-circumvention, origin fraud, illegal transshipment, or trade remedy measures.
Products at risk of being subject to trade remedies are very diverse, from wooden cabinets, plywood, artificial stone, ceramic tiles, copper pipes, gas cylinder covers,…
First of all, sofas with wooden frames are exported to the US from Vietnam from 819 million USD in 2018 to 1.4 billion USD in 2019 and 2.1 billion USD in 2020. In the period from December 2020 to November 2021, Vietnam’s turnover is up to 3.1 billion USD, up 52.1% over the same period last year. Currently, import turnover from Vietnam accounts for 38.3% of the total import turnover of the US and this item is also on the list of imported goods from China that are being subject to 25% duty by this country.
Another Vietnamese export item to the US, ceramic tiles, has also achieved significant growth, from 269,000 USD in 2018 to 2.8 million USD in 2019. Only in the 12-month period, from December 2020 to November 2021, Vietnam’s turnover reached 23.4 million USD, nearly doubled over the same period last year. However, we need to be careful because the US has applied anti-dumping and anti-subsidy duties on similar products imported from China since April 2020. Accordingly, we need to closely monitor the export of ceramic tiles to the US and take timely measures to prepare if an anti-dumping decision is imposed.
Vietnam’s exports to the US are at risk of being subject to trade remedies
Another product exported to the US market that has also been warned that there is a risk of investigation and application of trade remedies is plywood from hardwood materials.
Moreover, plywood products from hardwood plywood exported to the US need to be especially careful because Vietnam’s export turnover to the US has increased rapidly from 33.4 million USD in 2016 to 322.2 million USD in 2019.
In the 12-month period from June 2020 to May 2021, Vietnam’s export turnover reached 407.3 million USD. The growth rate has decreased, only increasing by 11.3% over the same period last year, however, import turnover from Vietnam still accounts for 25% of the total import turnover of the US.
The US has officially applied anti-dumping and anti-subsidy duties on similar products imported from China since November 2017.
In October 2019, the US Customs and Border Protection Agency released an official notice to investigate the evasion of trade remedy for some US companies importing plywood from Vietnam.
In June 2020, the US Department of Commerce initiated an investigation into the evasion of trade remedy for all plywood products imported from Vietnam. In October 2020, the United States Trade Representative (USTR) announced the initiation of an investigation into the import and use of raw materials illegally harvested and traded in Vietnam.
Currently, the anti-dumping investigation cases for some products exported from Vietnam to the US have not yet reached a final conclusion.
