On December 5, 2023, the Ministry of Industry and Trade of Vietnam issued Decision No. 3133/QD-BCT regarding the second review of the application of anti-dumping measures on Chinese H-shaped steel products.
On March 21, 2017, the Ministry of Industry and Trade issued Decision No. 957/QD-BCT on the temporary determination of anti-dumping measures application on certain H-shaped steel products imported into Vietnam from China (including Hong Kong).
On August 21, 2017, the Ministry of Industry and Trade of Vietnam issued Decision No. 3283/QD-BCT on the official determination of anti-dumping measures application on H-shaped steel products imported into Vietnam from China.
On August 19, 2022, the Ministry of Industry and Trade issued Decision No. 1640/QD-BCT on the end-of-term review results. Accordingly, the anti-dumping measures on H-shaped steel products were extended for an additional 5 years.
The H-shaped steel products involved in this case, known as “H-beams,” “W-beams,” or wide flange beams, are classified under HS codes: 7216.33.11, 7216.33.19, 7216.33.90, 7228.70.10, and 7228.70.90.
According to Article 58(1) of Decree No. 10/2018/ND-CP, within 60 days before the end of the first year from the date of the decision to apply formal anti-dumping measures or the latest decision on the review results, relevant parties may submit a request for review.
Based on this provision, the Jinxi Group, consisting of the manufacturer Hebei Jinxi Section Steel and four affiliated trading companies, submitted a request for review. The Trade Remedies Authority confirmed the receipt of a valid application from this group.
Vietnam reviews for the second time the application of anti-dumping measures on Chinese H-shaped steel products
After reviewing the documents submitted in accordance with legal regulations, on December 5, 2023, the Ministry of Industry and Trade issued Decision No. 3133/QD-BCT on the second review of the application of anti-dumping measures on Chinese H-shaped steel products.
The review period extends from October 1, 2022, to September 30, 2023. Within 60 days from the effective date of the review decision, organizations and individuals can register as related parties to access information during the review process, submit opinions, comments, information, and evidence to protect their interests.
Subsequently, within 15 days from the issuance of the review decision, the investigating authority will send a questionnaire to the relevant parties deemed necessary.
Within 30 days from receiving the questionnaire responses, the relevant parties must submit comprehensive answers for the investigating authority to conduct a review and assessment. This period may be extended up to 30 days with valid reasons based on written requests from the relevant parties.
The language used in the review process is Vietnamese. If the relevant parties use a language other than Vietnamese, a certified Vietnamese translation must be attached. The parties are responsible for the accuracy and validity of the compiled and translated information.
Collaboration during the investigation is crucial. Lack of full cooperation or determined lack of good faith cooperation may result in unfavorable decisions based on available information.
The review period is 6 months from the date of the review decision, with a one-time extension possible, but not exceeding 3 months.
