On December 11, 2023, the Ministry of Industry and Trade of Vietnam issued Decision No. 3180/QD-BCT regarding the review of new exporters in the case of applying anti-circumvention measures on trade remedy products, specifically sugar, from 5 Southeast Asian countries: Cambodia, Indonesia, Laos, Malaysia, and Myanmar.
On February 9, 2021, the Ministry of Industry and Trade of Vietnam issued Decision No. 477/QD-BCT imposing temporary anti-dumping and countervailing duties on sugar products originating from Thailand.
On June 15, 2021, the Ministry of Industry and Trade of Vietnam continued with Decision No. 1578/QD-BCT, officially applying anti-dumping and countervailing measures to certain sugar products imported into Vietnam from Thailand.
On September 21, 2021, the Ministry of Industry and Trade issued Decision No. 2171/QD-BCT, initiating an investigation into the application of anti-circumvention measures on sugar products originating from Thailand, allegedly circumventing measures through 5 ASEAN countries: Laos, Cambodia, Indonesia, Malaysia, and Myanmar.
On August 1, 2022, the Ministry of Industry and Trade of Vietnam issued Decision No. 1514/QD-BCT, applying anti-circumvention measures on sugar products from 5 countries (case code: AC02.AD13-AS01). The anti-circumvention measures on sugar products from 5 Southeast Asian countries have anti-dumping duties of 42.99% and countervailing duties of 4.65%, varying based on origin, exporting company, and type of certificate of origin.
On November 15, 2023, the investigating authority, the Trade Remedies Authority, announced the receipt of a complete and valid dossier from Kampong Speu Sugar Company requesting a review of new exporters in the case of applying anti-circumvention measures on sugar products from 5 ASEAN countries.
According to Kampong Speu Sugar Company, they propose a review by the investigating authority to confirm that their company should not be subject to anti-circumvention measures on trade remedy products.
Based on the regulations in Article 3 of Article 82 of the Law on Foreign Trade Management and Article 65 of Decree No. 10/2018/ND-CP, on December 11, 2023, the Ministry of Industry and Trade issued Decision No. 3180/QD-BCT regarding the review of new exporters in the case of applying anti-circumvention measures on trade remedy products, specifically sugar.
