On April 24, 2024, the Vietnam Trade Remedies Authority issued an official announcement regarding the acceptance of applications for the end-of-term review of the application of anti-dumping measures on plastic products and plastic products made from polymers of propylene from Malaysia, Thailand, and China.
According to the provisions of Article 62(2) of Decree No. 10/2018/ND-CP, within 30 days from the date of this announcement by the investigating authority, domestic manufacturers have the right to submit applications for the end-of-term review of the application of anti-dumping measures. The deadline for the Vietnam Trade Remedies Authority to receive applications is no later than May 24, 2024.
On July 20, 2020, the Ministry of Industry and Trade issued Decision No. 1900/QD-BCT on the official imposition of anti-dumping duties on certain plastic products and plastic products made from polymers of propylene originating from Malaysia, Thailand, and China.
On September 24, 2021, the Vietnamese Ministry of Industry and Trade issued Decision No. 2201/QD-BCT regarding the first review of the application of anti-dumping measures on certain plastic products and plastic products made from polymers of propylene originating from Malaysia, Thailand, and China.
On July 15, 2022, the Vietnamese Ministry of Industry and Trade issued Decision No. 1403/QD-BCT regarding the results of the first review of the application of anti-dumping measures on certain plastic products and plastic products made from polymers of propylene originating from Malaysia, Thailand, and China, based on the request for review by the interested party as prescribed in Article 82(1) of the Law on Foreign Trade Management 2017.
On November 14, 2022, the Vietnamese Ministry of Industry and Trade issued Decision No. 2400/QD-BCT regarding the review of new exporters in the case of the application of anti-dumping measures on certain plastic products and plastic products made from polymers of propylene originating from Malaysia, Thailand, and China.
According to the provisions of Article 82(2) of the Law on Foreign Trade Management, 1 year before the expiry of the anti-dumping measures, the Minister of Industry and Trade shall decide to conduct an end-of-term review of the application of anti-dumping measures.
The content of the end-of-term review is detailed in Article 82(2) of the Law on Foreign Trade Management and Article 63 of Decree No. 10/2018/ND-CP. Applications must be submitted directly to the Vietnam Trade Remedies Authority within the specified period.
Enterprises engaged in the production and export of plastic products and plastic products made from polymers of propylene originating from Malaysia, Thailand, and China should take note of this deadline to plan their preparations accordingly.
