On November 13, 2023, the Investigating Agency, the Trade Remedies Authority of the Ministry of Industry and Trade of Vietnam, issued Notice No. 178/TB-PVTM regarding the extension of the deadline for responding to questionnaires in the anti-dumping investigation of wind tower products from China (case code: AD18) for foreign manufacturers/exporters.
On October 10, 2023, the Trade Remedies Authority of Vietnam issued Notice No. 107/TB-PVTM, officially sending the questionnaire to foreign manufacturers/exporters involved in case AD18. The original deadline for responding was set for 5:00 PM on November 16, 2023 (Hanoi time).
However, several businesses raised concerns with the Investigating Agency, stating insufficient time to gather relevant information and data for a comprehensive, fair, and accurate response to the questionnaire. Consequently, some companies submitted requests urging the Trade Remedies Authority to extend the deadline for submitting responses in the anti-dumping investigation of wind tower products from China.
In order to facilitate foreign manufacturers/exporters in providing comprehensive responses, the Investigating Agency issued Notice No. 178/TB-PVTM on November 13, 2023, extending the deadline for submitting questionnaire responses to 5:00 PM on December 15, 2023 (Hanoi time), based on Article 2, Decree No. 10/2018/ND-CP. After this deadline, the Investigating Agency may utilize available data as per legal provisions on trade remedies.
Vietnam Extends Deadline for Submission of Questionnaire Responses in Anti-Dumping Investigation of Wind Tower Products from China for Foreign Manufacturers/Exporters
On September 25, 2023, the Ministry of Industry and Trade issued Decision No. 2494/QD-BCT on the imposition of anti-dumping measures against wind tower products originating from China.
The investigated products are classified under HS codes 7308.20.11 and 7308.20.19. In the case of import as part of wind-powered generator sets, the products are classified under HS codes 8502.31.10 and 8502.31.20.
The decision to initiate the investigation into wind tower products from China was based on the assessment of the file requesting the application of anti-dumping measures submitted by domestic manufacturing representatives on July 25, 2022, including CS WIND Vietnam Co., Ltd., and Southern Green Energy and Renewable Co., Ltd.
As of now, the deadline for submitting questionnaire responses in the ongoing investigation has been extended for all relevant parties, including foreign manufacturers/exporters. Previously, according to Notice No. 157/TB-PVTM, only domestic manufacturers and import companies were granted an extension for submitting questionnaire responses in the wind tower product case from China.
For other matters, companies continue to follow the instructions in the official questionnaire issued under Notice No. 107/TB-PVTM.
