According to the Tariff Act of 1930, the U.S. Department of Commerce will automatically conduct sunset reviews every 5 years for anti-dumping duty and countervailing duty orders listed by the DOC. The United States International Trade Commission (ITC) simultaneously announced this notice of the 5-year sunset review of similar duty orders and investigations currently suspended.
According to the U.S. Department of Commerce, the subject of the sunset review is wind tower products, with HS codes 7308.20.0020 and 8502.31.0000. Vietnamese wind tower products were subjected to anti-dumping investigations by the United States in 2012 and taxed in 2013 at rates ranging from 51.54% to 58.54%.
This is the second sunset review initiated by the United States concerning Vietnamese wind tower products. Under U.S. law, sunset reviews are conducted every 5 years. If the review results show that terminating the anti-dumping duty could lead to continued or recurrent dumping, causing significant harm to the domestic industry of similar products in the U.S. market, the duty order will be extended for another 5 years.
In the event that the review yields contrary results, the duty order will be terminated or adjusted accordingly based on the actual situation.
