On March 8, 2024, the United States International Trade Commission (USITC) issued a notice initiating a global safeguard investigation to fine denier polyester staple fiber under HS code 5503.20.0025.
The investigation was launched by the USITC on February 28, 2024, following a petition from U.S. producers of polyester staple fiber, including Fiber Industries LLC d/b/a Darling Fibers; Nan Ya Plastics Corp, America; and Sun Fiber LLC.
The petition alleges that imports of polyester staple fiber from countries with significant exports of this product to the U.S. market have surged, causing serious injury and impacting domestic production.
According to USITC data, during the period of 2021-2023, exports of the investigated product from Vietnam to the United States amounted to approximately $5.9 million. In 2023 alone, exports of the investigated product from Vietnam were $5.2 million, ranking eighth among countries exporting to the United States and accounting for 3% of total U.S. import market share.
In 2017, the United States initiated anti-dumping investigations against fine denier polyester staple fiber from South Korea, India, China, Taiwan, and Vietnam; countervailing duty investigations against China and India; however, Vietnam was subsequently excluded from the scope of the investigation upon the request of the petitioner.
As of now, South Korea, India, China, and Taiwan are still subject to anti-dumping/countervailing duties. Vietnam’s exclusion from the previous investigation does not imply that Vietnamese enterprises will automatically be deemed not to engage in dumping/subsidy practices in this global safeguard investigation.
The USITC has determined that this investigation is “extremely complex” and will render a decision on injury by July 9, 2024. The commission will submit to the President a report required under section 202(f) of the Trade Act within 180 days from the filing date, anticipated to be by August 26, 2024.
Interested parties will have 21 days from the issuance date of the notice to register for participation and receive information about the case. The USITC plans to hold one injury hearing and one remedy hearing.
For the injury hearing (scheduled for June 4, 2024), the deadline for registration is May 24, 2024, and the deadline for submission of injury comments is May 28, 2024.
For the remedy hearing (scheduled for July 23, 2024), the deadline for registration is July 17, 2024, and the deadline for submission of remedy comments is July 16, 2024.
Even if not registered, parties may still submit injury comments by June 11, 2024, and remedy comments by July 29, 2024.
The USITC plans to issue injury determinations on July 9, 2024, and report to the President for consideration, with a decision expected within 180 days from the filing date, by August 26, 2024.
