Recently, the United States Department of Commerce (DOC) issued an official notice further extending the deadline for issuing final determinations on scope investigations, preliminary determinations, and final determinations on the circumvention investigation of anti-dumping and countervailing duties applied to Chinese wooden cabinets imported from Vietnam.
On May 24, 2022, the United States Department of Commerce initiated a scope investigation to determine whether wooden cabinets, vanity units, and components of wooden cabinets imported from China are further processed in Malaysia or Vietnam, and then exported to the United States, falling within the scope of the anti-dumping and countervailing duty orders on wooden cabinets from China.
Since April 2020, the United States has imposed anti-dumping and countervailing duties on wooden cabinets originating from China, with anti-dumping duties ranging from 4.37% to 262.18%, and countervailing duties ranging from 13.33% to 293.45%.
On September 21, 2022, the Department of Commerce extended the deadline for issuing final scope determinations by an additional 177 days until March 17, 2023. On March 16, 2023, the Department of Commerce exercised its authority to issue preliminary scope determinations.
On March 16, 2023, the Department of Commerce extended the deadline for issuing final scope determinations by an additional 93 days until June 16, 2023. On June 2, 2023, the Department of Commerce extended the deadline for issuing final scope determinations by an additional 62 days until August 17, 2023.
On August 10, 2023, the Department of Commerce extended the deadline for issuing final scope determinations by an additional 46 days until October 2, 2023. On September 29, 2023, the Department of Commerce extended the deadline for issuing final scope determinations by an additional 120 days until January 26, 2024.
From September 19, 2023, to December 11, 2023, the Department of Commerce received comments and rebuttals regarding scope determinations in the investigation.
The Department of Commerce needs time to respond to these comments and prepare and make final determinations. Therefore, under U.S. trade remedy law, the DOC continues to announce an extension of the deadline for issuing final determinations in this scope matter by an additional 70 days until April 5, 2024.
For the circumvention investigation, the DOC also extends the deadline for issuing preliminary and final determinations of the circumvention investigation of anti-dumping and countervailing duties with Vietnamese wooden cabinets to April 19 and July 18, 2024, respectively.
