Recently, the Philippine Tariff Commission (TC) issued a notice to continue the safeguard investigation on steel gas cylinders imported. This is a follow-up investigation after the Department of Trade and Industry of the Philippines conducted a preliminary inquiry. It is expected that TC will complete the investigation and submit a report to the Minister of Trade and Industry of the Philippines within 120 days.
In April 2023, the Department of Trade and Industry of the Philippines (DTI) issued a notice to conduct a safeguard investigation on steel gas cylinders imported. The product under investigation is steel gas cylinders (LPG Steel Cylinders) with the AHTN code 7311. The petitioner is Ferrotech Steel Corporation. The investigation covers the period from 2017 to 2021.
Safeguard investigation on imported goods
Based on the provisions of Article XIX of the General Agreement on Tariffs and Trade (GATT) 1994, emergency measures, including safeguard measures, are one of the trade remedy measures that a country can apply to protect its domestic industry and economy from harm or the threat of harm caused by imports.
Based on the provisions of Article 91, Clause 1 of the 2017 Law on Foreign Trade Management, safeguard measures for imported goods into Vietnam are applied in cases where the excessive importation of goods into Vietnam causes or threatens to cause serious damage to the domestic industry.
Thus, if there is evidence that the rapid increase in the importation of goods from foreign countries into the market causes or threatens to cause serious harm to the domestic industry, the country can apply safeguard measures to temporarily restrict imports of one or more types of goods.
