On January 21, 2022, the Directorate General of Trade Remedies of India (DGTR) sent a notice to initiate an anti-dumping investigation against a number of vinyl flooring products (vinyl tiles other than in roll or sheet form) originating or imported from China, Taiwan and Vietnam.
The Department of Trade Remedies (Ministry of Industry and Trade) stated that the Directorate General of Trade Remedies (DGTR) under the Ministry of Industry and Trade of India has initiated an anti-dumping investigation on some vinyl floor covering products that are not in rolls or sheets form originating or exported from China, Taiwan, and Vietnam.
DGTR initiated an investigation into the incident after receiving complaints from the companies. These companies allege that competitors’ dumping of products in the Indian market has seriously affected domestic trade since September 2019, namely the production and trading of this product in India.
Specifically, the plaintiff in the anti-dumping investigation for vinyl floor coverings originating or imported from China, Taiwan, and Vietnam is Welspun India Co., Ltd., Welspun Flooring, Welspun Global Brands.
The goods under investigation included vinyl floor coverings classified under HS codes 3918.10.90; 3918.10.10, 3918.90.10, 3918.90.20 and 3918.90.90
The anti-dumping investigation period for vinyl floor coverings takes place from October 1, 2020, to September 30, 2021.

The related producers and exporters are required to download the survey questionnaire on the DGTR website: https://www.dgtr.gov.in/anti-dumping-guidelines/exporters-questionnaire
After that, related parties will have 30 days from the date of the initiation notice to submit responses to questions, comments, and arguments for DGTR to study and consider. In the event that no information is received, or incomplete or invalid information is received, DGTR will use available data to calculate the margin of dumping.
Relevant manufacturing/exporting enterprises need to carefully study documents and information related to the case and cooperate fully and comprehensively, strictly complying with DGTR’s instructions. At the same time, DGTR also recommends that the parties involved in the case consider consulting an experienced lawyer/consultant in the field of anti-dumping in the Indian market to achieve the best outcome.
Failure to provide or provide incomplete information as requested by DGTR may result in DGTR using available adverse evidence as a basis for a decision to impose high anti-dumping duties.
If dumping is determined to have caused damage to domestic producers, the DGTR will propose the imposition of anti-dumping duty on these imports.
After that, the Indian Ministry of Finance will make the final decision to impose anti-dumping measures on this product.
