India Initiates Safeguard Investigation on Non-Alloy and Alloy Steel Flat Products from Vietnam

Recently, the Directorate General of Trade Remedies (DGTR) of India announced the initiation of a safeguard investigation on imports of non-alloy and alloy steel flat products into India.

The investigation was initiated based on a petition filed by the Indian Steel Association, representing several major steel producers in India, such as Arcelor Mittal Nippon Steel, AMNS Khopoli, Jindal Steel and Power, and Steel Authority of India.

Product Under Investigation:
The investigated product includes non-alloy and alloy steel flat products classified under HS Codes: 7208, 7209, 7210, 7211, 7225, and 7226. The scope of the investigation covers hot-rolled steel, cold-rolled steel, corrosion-resistant metal-coated steel (including galvanized steel, cold-coated steel, zinc-magnesium alloy-coated steel), and color-coated steel.

Exclusions from Investigation:
The following steel products are excluded from the scope:

  • Cold-rolled grain-oriented electrical steel
  • Cold-rolled grain non-oriented electrical steel coil and sheet
  • Coated-electro galvanized steel
  • Tinplate
  • Stainless steel

Petitioner’s Allegations:
The petitioner alleged that the investigated products were imported into India in rapidly increasing and significant volumes, causing serious injury to the domestic industry. The unexpected factors leading to the surge in imports include:

  • The U.S. imposing a 25% tariff on steel under Section 232 of the Trade Expansion Act, prompting other nations to adopt consecutive trade remedy measures against steel imports.
  • Significant excess steel production capacity in China, Japan, and South Korea.
  • China’s domestic policy shifting from long steel production to flat steel for export.
  • Chinese investment in steel production in ASEAN countries.
  • India’s obligations under GATT 1994 and other agreements.

Investigation Period:
The investigation period is from October 1, 2023, to September 30, 2024. DGTR will also examine data from April 1, 2021, to March 31, 2022; April 1, 2022, to March 31, 2023; April 1, 2023, to March 31, 2024, and the investigation period.

The petitioner requested DGTR to impose provisional safeguard measures due to the existence of critical circumstances and to apply safeguard measures for four years.

Call for Submissions:
DGTR has invited interested parties to submit comments on the investigation and responses to the investigation questionnaires for producers, exporters, importers, the domestic industry, and the economic interest questionnaire.

The deadline for submitting relevant information is 15 days from the initiation notice publication date (initiation date: December 19, 2024), i.e., by January 2, 2025. If no information is received, DGTR will rely on available facts for the investigation.
