India initiates anti-dumping investigation on solar panel imports from China and Vietnam

On February 17, 2023, India issued an official notification regarding the initiation of an anti-dumping investigation on certain solar panel products from China and Vietnam.

The Directorate General of Trade Remedies (DGTR) is investigating allegations of dumping of patterned and uncoated toughened glass (solar panel or solar photovoltaic glass from China and Vietnam). Vietnam is becoming one of the main production hubs for solar panels globally. However, unrestricted production may lead to anti-dumping investigations and trade remedy measures.

Previously, the United States Department of Commerce initiated a similar investigation into Vietnamese solar panel products at the end of March 2022, along with Thailand, Malaysia, and Cambodia. However, due to the scarcity of these raw materials for green energy purposes, the United States temporarily exempted Vietnamese enterprises from duty imposition.

The petition for investigation was filed by Borosil Renewables Pvt. Ltd., representing the solar panel manufacturing industry in India. DGTR confirmed the validity of the petition and officially announced the commencement of the anti-dumping investigation on solar panel products from China and Vietnam. The final decision will be issued by the Ministry of Finance of India.

According to the petitioner, the volume of goods imported from Vietnam has increased both absolutely and relatively, causing injury to domestic manufacturing industries. The period of investigation (POI) is determined from January 1, 2023, to December 31, 2023 (12 months). Information on injury has been provided for the POI and the three preceding years.

In the following period, manufacturers and exporters in Vietnam will receive information from DGTR and are required to contact and submit responses to investigation questionnaires, providing accurate and timely information to the investigating authority (within 30 days from the notification date). Parties not listed in the petitioner’s complaint may voluntarily contact the investigating authority to register as interested parties.

Failure to fully cooperate with the investigating authority may result in adverse tax imposition on enterprises. If the investigating authority determines that Vietnamese enterprises have engaged in dumping practices causing material injury to Indian manufacturers of similar products, DGTR will recommend imposing anti-dumping duties on imported goods.

Currently, based on the petitioner’s data, it can be inferred that India has solid evidence of Vietnamese and Chinese enterprises engaging in dumping practices with the products under investigation. The subsequent investigation will clarify the extent of dumping of solar panel products as well as classify enterprises engaging in dumping practices and those not engaging in dumping practices for fair duty imposition.
